Terms and Conditions 1. Definitions " Company" means Listyou Ltd of Courtvollard, Trematon, Saltash, Cornwall, PL12 4RX" Customer" means the person or company who purchases the services." Services" means the Services specified in the Company’s invoice." Order" means the Customer’s Order in accordance with Condition 2 below." Invoice" means the Company’s Invoice which shall be deemed to incorporate the Company’s Terms and Conditions as here set out."Working Day" means ListYou Ltd’s hours of operation, namely between the hours of 9.00 a.m. and 5.00 p.m., Monday to Friday, excluding public holidays. 2. 3. Payment Remittances should be sent to the company’s address as set out in Condition 1. The company accepts Pounds Sterling. Payment can be made by cheque, cash or bank transfer. If your cheque is returned by the bank as unpaid for any reason, you will be liable for a "returned cheque" charge of £354. Payments Terms On all credit account invoices payment terms are strictly 7 days net unless agreed in writing. Overdue accounts will incur two per cent (2%) interest per month or part thereof and will be charged for third party recovery costs. Clients without agreed credit facilities have to pay in full before work commences. 5. Value Added Tax VAT will be added at the applicable rate to all invoices. 6. Executives and Staff Liability .In no event shall Listyou Ltd or its executives, staff or agents be liable to anyone for any delays, inaccuracies, errors or omissions with respect to the Information or service or delivery of all or any part thereof, for any damage arising there from or occasioned thereby, or for the results obtained from the use of information given or service or failure to comply 7. Information The customer requesting services, to her/his knowledge, does not violate trademark or other statutes. Any persons, companies or organisations shall not under any circumstances hold Listyou Ltd liable for any violations of trademark or other statutes. 8. Limitation of Liability i) Our total aggregate liability to you for any claim in contract, tort, negligence or otherwise arising out of or in connection with the provision of the Services shall be limited to the charges paid by you in respect of the Services which are the subject of any such claim; ii) In any event no claim shall be brought unless you have notified us of the claim within one year of it arising; iii) In no event shall we be liable to you for any loss of business, contracts, profits or anticipated savings or for any other indirect or consequential or economic loss whatsoever. |
